Backers of referendum against APEX Motor Club sue Maricopa

An organization seeking a referendum on a potential new motor sports park in Maricopa has filed a lawsuit against developers and Maricopa staff and elected officials in an effort to get the issue onto a ballot.

The civil case was filed in Pinal County Superior Court on Monday by Maricopa Citizens Protecting Taxpayers (previously named “Tax Payers”) and names the city of Maricopa, Mayor Christian Price, each of the six other city council members, City Clerk Vanessa Bueras and Private Motorsports Group LLC as defendants. The actual court documents were not yet ready to view as of press time.

Represented by Phoenix attorney Robert Rebich, MCPT is challenging a decision made by Bueras to decline to forward its petition to the Pinal County Recorder’s Office. Bueras said the petition, filed on June 2 with over 1,100 signatures, was disqualified because the issue at hand is not eligible for referendum under the Arizona Constitution.
