Opponents file 3rd suit; annexation area misses its chance to vote in town election

Residents fighting the town’s attempt to annex them have now filed a third lawsuit.

The latest suit, filed Oct. 1, appears to be “a rehash to an extent” of the two actions filed on Sept. 24, Town Attorney James Mannato said. He said he has filed a motion to consolidate the three cases and is also preparing a motion to dismiss.

These lawsuits stopped the town’s annexation of Magic Ranch, Crestfield Manor and Wildhorse Estates from taking effect on Oct. 3. Residents in those areas had previously been told they could vote in the town election on Nov. 4 and help select two Town Council members, but that is no longer the case.
