Town’s claim for Florence Copper land is dismissed

Florence CopperThe town of Florence’s attempt to acquire Florence Copper Inc.’s private property through   eminent domain has been dismissed in Maricopa County Superior Court.

The town sought eminent domain over two years ago, commenting at the time that other legal issues between and the town and Florence Copper left the town no other choice.

Judge Arthur T. Anderson granted motions from the Florence Copper to dismiss the claim on July 2. According to his ruling, he agreed with Florence Copper that the town’s claim was not “ripe,” meaning it was based on a situation that may never occur.

Anderson has yet to rule on the town’s request for a declaratory judgment that mining is illegal on Florence Copper’s property.
