Pinal County seeks to dismiss forfeiture lawsuit

Pinal CountyPinal County Attorney Lando Voyles and Sheriff Paul Babeu on Friday filed a motion in U.S. District Court to throw out a lawsuit brought on behalf of a San Tan Valley woman whose truck was confiscated and sold at auction under state forfeiture laws.

In August 2013, Rhonda Cox lent her $6,000 pickup truck to her son, who was subsequently arrested for stealing accessories he attached to the truck. Pinal County deputies seized the truck under state racketeering laws. Cox, who had no involvement in the theft, filed papers to get her truck back and allegedly was told by a deputy county attorney that she would pay court costs if she lost her appeal. Cox withdrew her application and lost her truck.
