Legal papers filed with STV incorporation petition argue developers can’t stop it

The steering committee for Vote San Tan Valley submitted its petition signatures, coming in at over 5,400, as the incorporation effort’s legal status was subject to question.
Shea Homes was widely believed to have put a definitive end to the effort, claiming that as a “declarant,” a developer still controlling a subdivision, its permission was required. While the steering committee had previously mentioned publicly that Arizona Senate Bill 1084 might take away the right of declarant control, a legal analysis of the statute submitted with the petition now argues that declarant control is not an issue under current law.
The steering committee’s lawyer, Kay Bigelow, said that the law is clear — declarants can’t put a stop to incorporation.
