ACC sues to force Johnson Utilities to follow orders

The Arizona Corporation Commission has filed suit to force Johnson Utilities to comply with the commission’s order and allow an interim manager to enter the premises and run the company.

Pinal County Superior Court Judge Stephen McCarville granted a preliminary injunction requiring the company to cooperate with the commission’s order on Wednesday.

The ACC filed its complaint Tuesday, the same day it issued its decision to appoint an interim manager to run the company. The complaint says company officials have previously indicated they’ll fight the decision. It requests an injunction preventing Johnson Utilities from taking any action to refuse compliance with the decision, plus an injunction preventing the company from blocking physical access to the plant to the interim manager. The suit further asks that the interim manager be given authority to physically secure the plant against company officials and others.
