Legal battle over Pinal road tax likely to extend into 2019

Oral arguments for Pinal County’s appeal of a Goldwater Institute lawsuit that blocked a new tax might not be heard until early 2019, according to an update given by County Manager Greg Stanley to the Board of Supervisors.

Tax Court Judge Christopher Whitten is expected to issue a final decision in mid-September on the legality of the Regional Transportation Authority tax, at which point the county will request a stay so the tax can continue to be collected while the appeal is processed.

Whitten effectively struck down the tax in an opinion issued at the beginning of August.
